The individual respondent (“Respondent”), acting as the legal representative of a company, participated in an international competitive bidding process within the framework of the Program to Support the Extension of Social Protection and Comprehensive Health Care (2431/OC-EC) (“Program”). The Office of Institutional Integrity (“OII”) submitted a Statement of Charges and Evidence against the Respondent for allegedly engaging in a fraudulent practice related to the Program and an obstructive practice during OII’s investigation. OII accused the Respondent of providing false information regarding the company´s technical and financial capabilities to meet bidding requirements, qualify for the contract award, and obtain financial benefits. Additionally, OII alleged that the Respondent engaged in an obstructive practice during the investigation by impeding access to relevant information and hindering the Bank’s inspection and audit rights. Consequently, and in accordance with the Sanctions Procedures, the Sanctions Officer (“SO”) issued a Notice of Administrative Action (“Notice”) to the Respondent. In its Response to the Notice, the Respondent refuted OII’s allegations. 

During the administrative proceedings, the company’s general manager informed the SO of the death of the Respondent. In accordance with Section 9 of the Protocol for the Delivery of Notices of Administrative Action in Relation to the Inter-American Development Bank Group’s Sanctions Proceedings, the SO declared the Notice null and void with respect to the Respondent and terminated the corresponding sanctions proceeding against the Respondent. The SO Determination was final.
